These Terms of Service constitute a legally binding agreement between you and Sri Athi Mobiles, a sole proprietorship registered under the laws of India, having its registered office at Tirunelveli, Tamil Nadu, India ("Sri Athi Mobiles", "TamilDM", "we", "us", or "our"), governing your use of the TamilDM service, application, and website accessible at tamildm.com (collectively, the "Service").

By registering for an account, clicking "I Agree", or accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
These Terms incorporate by reference our Privacy Policy available at tamildm.com/privacy. Together, these documents form the complete agreement between you and Sri Athi Mobiles.
⚠️ IMPORTANT:
These Terms contain a binding arbitration provision (Section 20) under the Arbitration and Conciliation Act, 1996 (India). Please read it carefully as it affects your legal rights.
Section 1. Description of Service
TamilDM is an AI-powered multi-platform automation and live engagement suite that helps businesses and individuals automate audience interactions across Instagram and YouTube. The Service is accessible via tamildm.com and any associated mobile applications.
TamilDM currently provides the following feature sets:

| AI Engine | Cross-platform AI layer providing reply generation, comment classification, content rewriting, moderation scoring, and variant creation powered by third-party AI providers. |
Section 2. Account Registration and Security
To use the Service, you must register and create an account, providing your name, email address, and connecting your Instagram and/or YouTube account(s) via the respective platform APIs.
You agree to:
- Provide true, accurate, current, and complete information during registration.
- Keep your account information up to date.
- Maintain the confidentiality of your account password and not share it with any third party.
- Be solely and fully responsible for all activities that occur under your account.
- Notify us immediately at support@tamildm.com if you suspect any unauthorised access.
Your account is personal to you and may not be transferred. Sri Athi Mobiles expressly disclaims any liability arising from unauthorised use of your account.
Section 3. Instagram Integration and Compliance
By connecting your Instagram account, you confirm that:
- You are the authorised manager or owner of the connected Instagram account.
- You consent to TamilDM processing Instagram data strictly to provide the automation features you configure.
- You will use the Service in full compliance with Meta's Platform Policies, Instagram's Terms of Use, and Instagram's Community Guidelines.
- Automated replies are sent only in response to user-initiated interactions within Meta's 24-hour messaging window.
- You will not use the Service to send spam or any content that violates Meta's policies.
- You are solely responsible for obtaining any required consents from end users.
- You are responsible for all automated messages and flows configured through your account, including those generated by AI features.
Section 4. YouTube Integration and Compliance
YouTube API Services Disclosure: TamilDM uses YouTube API Services. By using TamilDM's YouTube features, you agree to be bound by the YouTube Terms of Service.
4.1 YouTube Comment Automation
TamilDM's YouTube Comment Automation feature enables keyword-triggered automated replies and moderation actions on your YouTube video comments. By using this feature, you confirm that:
- You are the authorised owner or manager of the connected YouTube channel.
- You consent to TamilDM accessing your YouTube channel data, video listings, and comment threads strictly to execute your configured automation rules.
- You will comply with the YouTube Terms of Service, YouTube Community Guidelines, and YouTube's spam and deceptive practices policies at all times.
- Automated and AI-generated replies will not be used to spam, harass, mislead, or manipulate comment sections.
- You will not use automation to artificially inflate engagement metrics or circumvent YouTube's moderation systems.
- You are the publisher of all content posted to YouTube through TamilDM, including AI-generated content, and you are solely responsible for it.
4.2 YouTube Live Chat Bot
TamilDM's YouTube Live Chat Bot enables real-time automated moderation, command responses, AI-generated messages, and audience engagement during YouTube live streams. By using this feature, you confirm that:
- You are the authorised owner or manager of the connected YouTube channel and live stream.
- You consent to TamilDM accessing your live stream metadata, live chat messages, viewer usernames, and profile information strictly to provide live chat automation features.
- You will configure and monitor your live chat bot in compliance with the YouTube Terms of Service and YouTube Community Guidelines.
- You will not use the live chat bot to flood chats, harass viewers, promote prohibited content, or violate YouTube's live streaming policies.
- You understand that YouTube may restrict or terminate API access for policy violations, and TamilDM bears no responsibility for such actions.
4.3 Revoking YouTube Access
You may revoke TamilDM's access to your YouTube data at any time via your Google Security Settings. Revoking access disables all YouTube features in TamilDM but does not affect your Instagram automations or billing.
Section 5. Artificial Intelligence Features
AI-Powered Platform: TamilDM is an AI-powered platform. The features described in this section use machine learning models to generate content, classify inputs, and take automated actions on your behalf. Please read this section carefully.
5.1 AI Features Overview
TamilDM's AI engine currently provides the following capabilities across Instagram and YouTube:
- AI Reply Generation: Automatically drafts replies to comments and messages based on your configured tone and context.
- AI Comment Classification: Analyses incoming comments and messages to classify intent, sentiment, and rule-trigger eligibility.
- AI Content Rewriting: Rewrites your draft messages for clarity, tone, or platform-specific style.
- AI Reply Variants: Generates multiple reply options for you to choose from or auto-deploy.
- AI Moderation Scoring: Assigns moderation scores to comments to assist with automated accept/reject decisions.
5.2 No Accuracy Guarantee
AI-powered features use machine learning models that may occasionally produce incorrect, unexpected, biased, or inappropriate results. TamilDM does not guarantee the accuracy, appropriateness, completeness, or suitability of any AI-generated output.
- AI classification may incorrectly match or fail to match comments that should trigger your rules.
- AI-generated replies may not reflect your intended tone, message, brand voice, or factual accuracy.
- AI outputs are not reviewed by TamilDM staff before being suggested or posted.
- AI moderation scoring is probabilistic and may result in false positives or false negatives.
5.3 User Responsibility for AI Content
⚠️ IMPORTANT:
You are responsible for all AI-generated content posted through your account. Enabling auto-execute mode means TamilDM will post AI-generated replies and take moderation actions without your manual review of each action. By enabling autonomous AI execution, you accept full responsibility for all resulting actions.
Specifically, you acknowledge and accept that:
- You are the publisher of all content posted through TamilDM, whether manually created or AI-generated.
- You are solely responsible for reviewing, testing, and monitoring your AI-enabled rules to ensure they behave as intended.
- TamilDM is not liable for any consequences resulting from autonomous AI actions, including but not limited to reputational damage, account penalties, platform strikes, or channel bans.
- You cannot hold TamilDM responsible for any damages arising from AI-generated content that violates platform policies, third-party rights, or applicable law.
5.4 Third-Party AI Providers
TamilDM's AI features may be powered in whole or in part by third-party AI service providers (including but not limited to Google Gemini, OpenAI, and similar services). By using AI features, you acknowledge that:
- Your content may be processed by third-party AI providers subject to their own terms of service and privacy policies.
- TamilDM will take reasonable steps to ensure data is processed in accordance with our Privacy Policy, but we cannot guarantee the practices of third-party AI providers.
- Third-party AI providers may change, restrict, or discontinue their services at any time, which may affect TamilDM's AI features without prior notice to you.
5.5 AI Rate Limits
AI features are subject to usage rate limits and monthly quotas. These limits are determined by your subscription tier and are displayed on the Pricing page at tamildm.com/pricing. TamilDM reserves the right to throttle or temporarily suspend AI features if usage patterns suggest abuse, circumvention, or cost-amplification attacks.
Section 6. Beta Features
From time to time, TamilDM may make certain features available to users on an early-access or beta basis ("Beta Features"). Beta Features may include, without limitation, experimental AI capabilities, new platform integrations, early YouTube feature access, or preview automation tools.
Beta Feature Notice: Beta Features are provided for testing and evaluation purposes. They are not covered by the same service level expectations as generally available features.
By using Beta Features, you acknowledge and accept that:
- Beta Features may be modified, limited, suspended, or permanently removed at any time without prior notice.
- Beta Features may contain bugs, errors, or instabilities that affect your account or automation outputs.
- TamilDM provides no warranty, uptime guarantee, or support SLA for Beta Features.
- Beta Features may be subject to additional terms that will be presented to you at the time of activation.
- Removal or modification of a Beta Feature does not entitle you to a refund or service credit.
Section 7. User-Generated Content
"User-Generated Content" means any content, automations, flows, messages, commands, bot rules, or other material that you create, configure, upload, or make available through the Service — including content generated by AI features at your direction.
You are solely responsible for your User-Generated Content. Sri Athi Mobiles acts as a passive conduit and:
- Is not involved in the creation or development of your User-Generated Content.
- Disclaims any responsibility for your automations, messages, or bot commands, whether manually written or AI-generated.
- Is not liable for claims arising out of or relating to your User-Generated Content.
- Reserves the right to remove User-Generated Content or suspend your account if we determine it violates these Terms or applicable law.
Section 8. Prohibited Uses
You may not use the Service for any of the following:
- Any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
- Sending spam, bulk unsolicited messages, chain letters, or phishing attempts on any platform.
- Harassing, abusing, defaming, threatening, or intimidating any person.
- Impersonating any person or entity, or misrepresenting your affiliation.
- Attempting to gain unauthorised access to any part of the Service, other accounts, or related systems.
- Reverse engineering, decompiling, or disassembling any part of the Service.
- Violating the policies of Meta, Instagram, Google, YouTube, or any other integrated platform.
- Using automation to artificially inflate engagement metrics, game recommendation algorithms, or circumvent platform moderation.
- Spamming YouTube comment sections or live chats with repetitive, generic, or deceptive automated messages.
- Using AI features to generate, distribute, or post harmful, illegal, defamatory, or misleading content.
Section 9. Service Abuse and Infrastructure Protection
In addition to the prohibited uses in Section 8, the following activities constitute abuse of TamilDM's infrastructure and are strictly prohibited:
9.1 Quota Circumvention
- Deliberately structuring API calls, automation triggers, or account usage to circumvent usage quotas, rate limits, or tier restrictions.
- Creating multiple accounts, using proxies, or employing technical workarounds to exceed your subscription's defined limits.
- Sharing account credentials to allow multiple users to collectively circumvent per-account limits.
9.2 Cost-Amplification Attacks
- Deliberately triggering excessive AI generations, API calls, or automation executions in a manner designed to consume disproportionate computational resources.
- Configuring rules or automations with the intent to amplify API costs incurred by TamilDM rather than to serve a legitimate business purpose.
- Exploiting rule-trigger loops, webhook floods, or queue-abuse patterns to artificially inflate resource consumption.
9.3 Automated Attacks
- Submitting automated requests to TamilDM's APIs at a rate that degrades service performance for other users.
- Attempting to exploit, probe, or stress-test TamilDM's infrastructure without prior written authorisation.
- Using the Service to facilitate distributed denial-of-service attacks, credential stuffing, or any other form of technical attack against TamilDM or any third-party platform.
Enforcement: TamilDM reserves the right to immediately suspend or terminate accounts engaged in infrastructure abuse, without notice and without refund. We may also pursue legal remedies for damages caused by deliberate abuse.
Section 10. Third-Party Platforms and Tools
The Service integrates with the following third-party platforms:
- Meta / Instagram: Governed by Meta's Platform Policies and Instagram's Terms of Use.
- Google / YouTube: TamilDM uses YouTube API Services. Your use of YouTube features is governed by the YouTube Terms of Service and Google Privacy Policy.
- Third-Party AI Providers: AI features may be powered by providers such as Google Gemini, OpenAI, or others. Their terms and privacy policies apply to data processed by their models.
- Razorpay: Payment processing is handled by Razorpay, subject to Razorpay's own terms and privacy policy.
Sri Athi Mobiles is not a party to your agreement with any third-party platform and is not responsible for the availability, accuracy, or conduct of any third-party platform or AI provider.
Section 11. Intellectual Property
All content, software, interfaces, graphics, trademarks, logos, AI models, and other proprietary material forming part of the Service ("TamilDM Content") are the exclusive property of Sri Athi Mobiles or its licensors. Nothing in these Terms grants you any ownership of or licence in TamilDM Content beyond the limited right to use the Service as set out herein.
Section 12. Billing, Payments, and Subscriptions
Payments for the Service are processed through Razorpay. By subscribing to a paid plan, you agree to provide valid payment information and authorise Sri Athi Mobiles to charge your chosen payment method for the applicable subscription fees.
- Recurring billing: Subscription fees are billed on a recurring basis (monthly or annually) and are due in advance.
- Auto-renewal: Unless you cancel before the end of your current billing period, your subscription will automatically renew.
- Refunds — General: Fees paid are non-refundable except where required by applicable law or at our sole discretion.
12.1 YouTube-Specific Refund Limitations
⚠️ IMPORTANT:
- YouTube API Changes: Google may change, restrict, or discontinue the YouTube Data API or YouTube Live Streaming API at any time. No refunds will be issued if YouTube modifies or revokes API access in a manner that limits or disables TamilDM's YouTube features.
- Quota Exhaustion: If you exhaust your monthly YouTube API quota before the end of a billing period, no refund or credit will be issued. You may upgrade your plan to access a higher quota.
- Channel Bans and Suspensions: If your YouTube channel is banned, suspended, or penalised by Google or YouTube, TamilDM is not responsible and no refunds will be issued.
- Loss of API Access: If Google or YouTube revokes your channel's API access or OAuth authorisation due to a policy violation on your part, no refund will be issued.
12.2 AI Feature Refund Limitations
- AI Provider Disruption: If a third-party AI provider changes, restricts, or discontinues their service in a way that affects TamilDM's AI features, no refund will be issued.
- AI Output Quality: Dissatisfaction with the accuracy, tone, or quality of AI-generated outputs does not constitute grounds for a refund, as AI output quality is inherently variable and cannot be guaranteed.
- AI Quota Exhaustion: If you exhaust your monthly AI generation quota before the end of a billing period, no refund or credit will be issued.
Section 13. Service Quotas and Limits
Each subscription tier includes defined usage quotas and limits for all supported platforms and AI features. Current limits for each tier are displayed on our Pricing page at tamildm.com/pricing.
We distinguish between two types of changes:

| Operational adjustments (e.g. temporary rate limiting, quota rebalancing for platform stability, security responses, or YouTube API compliance changes) | May take effect immediately without prior notice. We will communicate these changes as soon as reasonably practicable. |
Note: Operational quota adjustments are distinct from material legal changes to these Terms. Section 18 (Changes to Terms) governs notice requirements for legal amendments. This section governs notice for operational service limit changes. Continued use of the Service after any quota change constitutes acceptance of the updated limits.
Section 14. Termination and Suspension
Either party may terminate this agreement at any time. You may cancel your account through your account settings or by contacting support@tamildm.com.
Sri Athi Mobiles may suspend or terminate your access immediately and without prior notice if you: (a) breach any provision of these Terms; (b) violate the terms of any integrated platform including YouTube's Terms of Service; (c) engage in service abuse as described in Section 9; or (d) if we determine your use of the Service poses a risk to us, other users, or any third party.
Section 15. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SRI ATHI MOBILES DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR ANY PURPOSE; (C) YOUTUBE API SERVICES WILL REMAIN AVAILABLE OR UNRESTRICTED; OR (D) THIRD-PARTY AI PROVIDER SERVICES WILL REMAIN AVAILABLE OR UNCHANGED.
Section 16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SRI ATHI MOBILES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or in connection with your use of the Service, including but not limited to: damages arising from AI-generated content; YouTube API restrictions; channel bans or suspensions; quota exhaustion; loss of live stream access; third-party AI provider outages; or Beta Feature removal. Our total aggregate liability shall not exceed the fees paid by you in the preceding six months or ₹1,000 INR, whichever is greater.
Section 17. Indemnification
You agree to defend, indemnify, and hold harmless Sri Athi Mobiles and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any provision of these Terms; (c) your violation of any third-party platform policies including YouTube's Terms of Service; (d) any automated or AI-generated content posted through your account; (e) your use of Beta Features; (f) any service abuse as described in Section 9; or (g) any claim that your User-Generated Content caused damage to a third party.
Section 18. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice by posting the updated Terms on tamildm.com/terms and notifying you by email.
By continuing to use the Service after revised Terms become effective, you agree to be bound by them. If you do not agree to the new Terms, you must stop using the Service.
Clarification: The 30-day notice requirement in this section applies to material legal changes to these Terms. Operational quota and service limit adjustments are governed separately by Section 13 and may take effect on shorter notice as described therein.
Section 19. Governing Law and Severability
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
Section 20. Dispute Resolution — Arbitration
If any dispute arises out of or in connection with these Terms, you agree to first contact us at support@tamildm.com and attempt in good faith to negotiate a written resolution. If the dispute remains unresolved for 30 days, it shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Chennai, Tamil Nadu, India.
