These Terms of Service constitute a legally binding agreement between you and Sri Athi Mobiles, a sole proprietorship registered under the laws of India, having its registered office at Tirunelveli, Tamil Nadu, India ("Sri Athi Mobiles", "TamilDM", "we", "us", or "our"), governing your use of the TamilDM service, application, and website accessible at tamildm.com (collectively, the "Service").
PLEASE READ THESE TERMS CAREFULLY. By registering for an account, clicking "I Agree" or a similar button, or accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Service.
These Terms of Service incorporate by reference our Privacy Policy available at tamildm.com/privacy. Together, these documents form the complete agreement between you and Sri Athi Mobiles.
IMPORTANT: These Terms contain a binding arbitration provision (Section 17) under the Arbitration and Conciliation Act, 1996 (India). Please read it carefully as it affects your legal rights.
TamilDM provides an automation platform that enables businesses and individuals to create automated keyword-based reply flows for Instagram comments and Direct Messages using the Instagram Graph API. The Service is accessible via the web application at tamildm.com and through any associated mobile applications.
Your use of the Service is subject to this Agreement. If you have entered into a separate written agreement with us governing your use of the Service, that agreement will govern in the event of any conflict with these Terms.
To use the Service, you must register and create an account. As part of registration, you will be asked to provide your name, email address, and to connect your Instagram account via the Instagram Graph API.

Your account is personal to you and may not be transferred to any other person or entity. Sri Athi Mobiles expressly disclaims any liability arising from unauthorised use of your account.
By connecting your Instagram account and using the Service, you confirm that:
"User-Generated Content" means any content, automations, flows, messages, text, or other material that you create, configure, upload, or make available through the Service.
You are solely responsible for your User-Generated Content. Sri Athi Mobiles acts as a passive conduit for the delivery of your automations and:
By making User-Generated Content available through the Service, you grant Sri Athi Mobiles a non-exclusive, worldwide, royalty-free licence to process and use such content solely to the extent necessary to provide the Service to you.

We reserve the right to suspend or terminate your access to the Service immediately for any violation of these prohibited uses.
The Service integrates with third-party platforms, including Meta and Instagram. Your use of those platforms is governed solely by their own terms and conditions. Sri Athi Mobiles is not a party to your agreement with any third-party platform and is not responsible for the availability, accuracy, or conduct of any third-party platform.
The Service may also use third-party tools and service providers, including Razorpay for payment processing. Your use of Razorpay is subject to Razorpay's own terms of service and privacy policy. Sri Athi Mobiles is not responsible for any acts or omissions of Razorpay.
Links to third-party websites appearing on the Service do not constitute endorsement by Sri Athi Mobiles. You access third-party websites at your own risk.
All content, software, interfaces, graphics, trademarks, logos, and other proprietary material forming part of the Service ("TamilDM Content") are the exclusive property of Sri Athi Mobiles or its licensors. Nothing in these Terms grants you any ownership of or licence in TamilDM Content beyond the limited right to use the Service as set out herein.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose. You may not copy, distribute, modify, reproduce, republish, or create derivative works from any TamilDM Content without our express prior written consent.
If you submit suggestions, ideas, or feedback about the Service ("Feedback"), you agree that such Feedback is provided gratuitously and without restriction, and Sri Athi Mobiles may use it freely without any obligation or compensation to you.
Payments for the Service are processed through Razorpay. By subscribing to a paid plan, you agree to provide valid payment information and authorise Sri Athi Mobiles to charge your chosen payment method for the applicable subscription fees.
You are solely responsible for all taxes and fees associated with any transactions you conduct through the Service.
We may offer free trials or discounted introductory periods for paid plans. Unless you cancel before the end of the trial period, your payment method will be automatically charged the applicable subscription fee at the end of the trial. If you cancel during the trial, you will lose access to the Service at the end of the trial period. We reserve the right to modify or withdraw any trial offer at any time.
Either party may terminate this agreement at any time. You may cancel your account at any time through your account settings or by contacting us at support@tamildm.com.
Sri Athi Mobiles may suspend or terminate your access to the Service immediately and without prior notice if:

If your account is terminated for a breach of these Terms, you are prohibited from re-registering under any name without our prior written consent.
If there is no activity on your account (including login activity, automation activity, or payment transactions) for a continuous period of 18 months, we will endeavour to notify you by email and give you the option to keep your account open. If you do not respond within 30 days of that notice, we reserve the right to close your account and permanently delete all associated data.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SRI ATHI MOBILES MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR RESULTS OBTAINED THROUGH THE SERVICE.
YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SRI ATHI MOBILES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT THAT SRI ATHI MOBILES IS FOUND LIABLE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (I) THE TOTAL FEES PAID BY YOU TO SRI ATHI MOBILES IN THE SIX MONTHS PRECEDING THE CLAIM, OR (II) ONE THOUSAND INDIAN RUPEES (₹1,000).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Sri Athi Mobiles and its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
Sri Athi Mobiles reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to your indemnification, in which case you agree to cooperate with our defence of that claim.
You acknowledge that in the course of using the Service, you may have access to confidential information belonging to Sri Athi Mobiles, including but not limited to technical data, platform architecture, product roadmaps, pricing strategies, and business information ("Confidential Information"). You agree not to disclose, transfer, or use any Confidential Information for any purpose other than using the Service in accordance with these Terms. You will use reasonable efforts to protect Confidential Information from unauthorised disclosure.
These Terms and any matters arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. Subject to the arbitration provisions in Section 17, the courts at Chennai, Tamil Nadu, India shall have exclusive jurisdiction over any dispute not resolved by arbitration.
Sri Athi Mobiles reserves the right to modify these Terms at any time. We will endeavour to notify you of material changes by email or by a notice on the Service at least 15 days before the changes take effect. Your continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
